You could win a one-night stay for twopeople in a Deluxe King or Two Double Suite (One-Bedroom), valid from October 1st toApril 30th excluding event nights, New Year’s Eve and May 1st toSeptember 30th, and based on space availability. Parking andbreakfast are not included. Limit of one (1)entry per person. To win, a potential winner must have their entry picked by arandom computer-generated draw and sign a declaration and release form. Odds ofwinning depend on the number of eligible entries received. Contest is open toCanadian residents (excluding residents of Quebec) over the age of majority,and subject to the full contest rules.

By participating or attempting to participatein the Contest, you will be deemed to have received, understood, and agreed tothese Contest Rules. Who sponsors theContest?TheContest is sponsored and administered by BC Movement Arts Society. (“BCMAS”).Althoughthe Contest may be communicated, promoted, or administered by means of a thirdparty social media or social networking service or site, including Facebook andInstagram (each a “Third Party Service”),the Contest is in no way sponsored, endorsed or administered by, or associatedwith, any Third Party Service. Questions, comments or complaints regarding theContest should be directed to BCMAS and not to any Third Party Service. When can I enter theContest?Enterthe Contest between 12:01 am PT on 12:01 am PT, March 25, 2024and closes at 11:59 pm PT, April 5, 2024.  (the “ContestPeriod”). Who may enter theContest?TheContest is open only to residents of Canada (excluding residents of Quebec) whohave reached the age of majority in their province or territory of residence asof the date of entry.Thefollowing persons are not eligible to enter the Contest: (1) employees,officers, directors, representatives and agents of BCMAS, any of its affiliatesand any other companies associated with the Contest; (2) contractors of BCMASproviding services; and (3) members of the immediate family (spouse, parent,child, sibling) or household (whether or not related) of any person describedin (1) or (2) above. How do I enter theContest?Nopurchase is necessary to enter the Contest. You may enter the Contest bycompleting the entry form and submitting it along with your contact informationas directed on the webpage the “Submission Material”. BCMAS will not acknowledgereceipt of Contest entries.    How many times may Ienter the Contest?Thereis a limit of one (1) entry per person.  Can my entry berejected by BCMAS?BCMASreserves the right, in its sole discretion, to reject or refuse your entry if(1) you attempt to enter the Contest in a fashion not authorized by theseContest Rules; (2) your entry contains fraudulent or misleading information, oris late, falsified, illegible, damaged or incomplete or otherwise irregular;(3) your entry is submitted using robotic, automated, programmed, or otherillicit means; (4) your entry contains, depicts, displays, or involves any ofthe following: (i) any crude, vulgar, profanity, sexually graphic, offensive,“off-colour”, harassing, threatening, derogatory, demeaning, defamatory,racist, abusive, hateful, violent, obscene, or discriminatory images,depictions, symbols or material; (ii) any image, depiction, symbol, or materialrelating to drugs, cigarettes, or alcohol; (iii) any illegal statements,material, or content; (iv) any material that condones or incites violence,bullying or other unlawful behaviour; (v) any political content or propaganda;and (vii) any other content that is or could be considered inappropriate,unsuitable or offensive, all as determined by BCMAS in its sole discretion; or (5)you or your entry is not in compliance with these Contest Rule What are theconditions of entry?Byentering the Contest:(a)you agree to be bound by these Contest Rules and by the decisions of BCMAS,which decisions are final, binding and conclusive;(b)you represent and warrant to BCMAS that:(i)your entry, including any material comprising your entry (e.g., the SubmissionMaterial, your name, user name) and any other material submitted with yourentry (all such material, collectively, your “Full Entry”) is complete;(iii)your Full Entry does not contain copyright or trademark protected material ofany person other than you and BCMAS;(c)you understand and agree that your Full Entry will not be returned to you andmay be moderated or edited by BCMAS as it deems appropriate prior topublication by BCMAS;(d)you grant to BCMAS and its licensees the irrevocable right to use your name ifyou are the winner (the “PromotionalPurposes”), including the right to use your statements and images for BCMAS’sPromotional Purposes;(e)you waive all claims of moral rights in any use of your Full Entry by BCMASpursuant to the rights granted in these Contest Rules;(f)  you agree that BCMAS shall have the right atany time to require you to provide proof of identity or eligibility to enterthe Contest and that your failure to provide any such proof upon request mayresult in disqualification; and(g)you release and forever discharge BCMAS, its respective parents, affiliates,and subsidiaries, any other companies associated with the Contest, and all oftheir respective directors, officers, employees, agents, representatives,licensees, successors and assigns, as well as any Third Party Service,(collectively, the “Releasees”), andagree to indemnify and hold harmless each of the Releasees, from and againstany claims, damages or liability, including any costs or losses related topersonal injury, death, damage to or loss or destruction of property, resultingin whole or in part, directly or indirectly, from (1) your participation in theContest, (2) the awarding, receipt, possession, use or misuse of the Prize(defined below), in whole or in part, or any travel or activity related to anyPrize, (3) the use of any Full Entry in accordance with the rights granted inthese Contest Rules, or (4) any breach of these Contest Rules. What is the Prize?Thereis one (1) prize (the “Prize”) to be awarded in the Contest You couldwin a one-night stay for two people in a Deluxe King or Two Double Suite(One-Bedroom), valid from October 1st to April 30th excludingevent nights, New Year’s Eve and May 1st to September 30th,and based on space availability. Parking and breakfast are not included.  Inaddition to any prize conditions provided elsewhere in these Contest Rules, thePrize awarded in the Contest is subject to the following conditions: (a)BCMAS makes no warranties, express or implied, as to the condition, fitness ormerchantability of the Prize.(b)  The Prize must be accepted as awarded and maynot be transferred, changed or substituted for another prize, except asexpressly provided for in these Contest Rules.(c)BCMAS reserves the right to substitute the Prize, in whole or in part, with aprize or prize component of equal or greater value if the prize or prizecomponent cannot be awarded for any reason.(d)Any unused portion of the Prize, once awarded, will be deemed forfeited.  How will the potentialwinner be selected? One (1) potential winner will be selected by a randomcomputer generated draw.   How can a potentialwinner become a winner? Tobe declared a winner, a potential winner: (a)must be in compliance with these Contest Rules;(b)must sign and return a declaration and release (the “Release”), which (among other things): (i) confirms the potentialwinner’s eligibility for the Contest and compliance with the Contest Rules;(ii) acknowledges acceptance of the Prize as offered; (iii) confirms the grantof rights to BCMAS to use the Full Entry for the Promotional Purposes and asotherwise set out in the Contest Rules; and (iv) releases the Releasees (asdefined below) from any and all liability for any loss, harm, damages, cost orexpense arising out of participation in the Contest, participation in anyContest‑related activity or the acceptance, use or misuse of the Prize, and anyother documentation as reasonably required;and(e)provide any requested proof of identification to confirm eligibility or toclaim a Prize.. Ifa potential winner does not meet the above conditions, the Prize may beforfeited and BCMAS reserves the right, in its sole discretion, to  draw another eligible entry. What are the odds ofwinning a Prize?Theodds of winning a Prize depend on the number of eligible entries receivedduring the Contest Period. How do I find out whowon the Prize?Thepotential winner will be contacted using the provided contact information andonce the potential winner is confirmed as the winner, BCMAS will post thewinner’s name on its website. If BCMAS is unable to contact a potential winnerwithin 24 hours after the first attempt at contact, BCMAS may disqualify that potentialwinner and pick a new eligible entrant in accordance with the selectionprocess. How do I claim myPrize if I am a winner?Oncea potential winner is confirmed as a winner, prize distribution will becoordinated between the winner and BCMAS.Exceptas otherwise indicated by BCMAS, BCMAS will provide the tickets at the WillCall at Tidemark Theatre. If a winner fails to take delivery of the Prize asinstructed, the Prize may be deemed forfeited and BCMAS reserves the right, inits sole discretion, to ask to the Panel to select another eligible entry as apotential winner. How will my personalinformation be collected, used and disclosed? Byentering the Contest, you consent to BCMAS’s collection, use and disclosure ofyour personal information as BCMAS deems necessary for the administration ofthe Contest as described in these Contest Rules and for the PromotionalPurposes, as applicable.  Personalinformation will be held by BCMAS and be used for, and accessible to employees,contractors, licensees or representatives of BCMAS directly involved in theContest, for internal analysis, and for the Promotional Purposes, asapplicable.  You agree that if you areselected as a winner, BCMAS may use your personal information (including name,address, telephone numbers and/or email addresses) to administer the Contestand deliver the Prize.Formssubmitted online becomes the property of BCMAS. If you have any questionsregarding the collection, use, and storage of your personal information, pleasecontact info@bcmovementsarts.com  What laws apply to theContest? Thelaws of the province of British Columbia and the federal laws of Canadaapplicable therein apply to the Contest.Youagree that: (1) any and all disputes, claims, and causes of action arising outof, or connected with, this Contest or any Prizes shall be resolvedindividually, without resort to any form of class action, and exclusively bythe courts of British Columbia; (2) any and all claims, judgments and awardsshall be limited to actual out-of-pocket costs, but in no event including legalfees, disbursements or court costs; and (3) you waive all rights to claim,punitive, incidental and consequential damages, and any other damages, otherthan for actual out-of-pocket costs.BCMASreserves the right to seek any available legal remedy in connection with anyattempt to deliberately undermine the legitimate operation of the Contest. Can BCMAS cancel oramend the Contest, or change the Prize?BCMASmay cancel, modify, or suspend the Contest or amend these Contest Rules for anyreason whatsoever, at BCMAS’s sole discretion, without advance notice.Youmay not amend these Contest Rules in any way. BCMAS may exchange the Prize forone of similar value at its sole discretion. The Prize has no cash value orequivalent. Can BCMAS disqualifyor ban someone from a Contest?BCMASmay disqualify without notice or ban someone from the Contest or any futurecontest for any other reason, including if BCMAS finds that a person has (i)tampered with or attempted to tamper with, or undermined or attempted toundermine, the legitimate operation of the Contest, (ii) provided BCMAS with fraudulentor misleading information, (iii) acted in an disrespectful or disruptivemanner, or with the intent to annoy, abuse, threaten or harass any person, or(iv) otherwise violated these Contest Rules. Who makes decisionsabout the administration of the Contest?BCMASreserves the right to make all decisions relating to the administration of theContest, including the right to terminate, with or amend the Contest ordisqualify any entry for any reason.  Allsuch decisions of BCMAS are final and not subject to appeal. What happens if theseContest Rules contradict other Contest materials or are found to beunenforceable?Inthe event of any discrepancy or inconsistency between these Contest Rules anddisclosures or statements made by BCMAS or appearing in other Contest-relatedmaterials, these Contest Rules shall govern.Ifany part of these Contest Rules is legally unenforceable or inapplicable, thenthat part will be deemed invalid; however, the remainder of these Contest Ruleswill otherwise continue to be legally binding.
